Ba\u015fvurumuz, Bat\u0131 Trakya T\u00fcrk M\u00fcsl\u00fcman Az\u0131nl\u0131\u011f\u0131\u2019n\u0131n maruz kald\u0131\u011f\u0131 hak ihlallerine ili\u015fkin durum tespiti yapman\u0131n \u00f6tesinde; Yunanistan\u2019\u0131n uluslararas\u0131 hukuktan, bilhassa Lozan Bar\u0131\u015f Antla\u015fmas\u0131\u2019n\u0131n amir h\u00fck\u00fcmlerinden ve Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi\u2019nden ne\u015fet eden y\u00fck\u00fcml\u00fcl\u00fcklerini sistematik bi\u00e7imde yerine getirmedi\u011fini belgeleyen bir itiraz niteli\u011fi ta\u015f\u0131maktad\u0131r. Yunanistan\u2019\u0131n \u00f6nceki UPR d\u00f6ng\u00fclerinde kendisine sunulan tavsiyeleri uygulamadaki isteksizli\u011fini ve &#8220;etkin uygulama&#8221; (effective implementation) hususundaki eksikliklerini raporumuzda somut verilerle ortaya koyarak, BM nezdinde uluslararas\u0131 normlara uyum y\u00f6n\u00fcnde yeni ve cayd\u0131r\u0131c\u0131 bir bask\u0131 olu\u015fturulmas\u0131n\u0131 ama\u00e7l\u0131yoruz.<\/p>\n\n\n\n<p>Raporumuzun oda\u011f\u0131nda; \u00f6rg\u00fctlenme \u00f6zg\u00fcrl\u00fc\u011f\u00fc, din \u00f6zg\u00fcrl\u00fc\u011f\u00fc, vak\u0131f y\u00f6netimi ve az\u0131nl\u0131k e\u011fitimi olmak \u00fczere d\u00f6rt temel alan bulunmaktad\u0131r. \u00d6zellikle Avrupa \u0130nsan Haklar\u0131 Mahkemesi\u2019nin (A\u0130HM) 2008 tarihli kararlar\u0131n\u0131n ard\u0131ndan ge\u00e7en on yedi y\u0131la ra\u011fmen tam olarak icra edilmemesi ve az\u0131nl\u0131k derneklerinin &#8220;T\u00fcrk&#8221; kimli\u011fi gerek\u00e7e g\u00f6sterilerek hukuk d\u0131\u015f\u0131 k\u0131s\u0131tlamalara tabi tutulmas\u0131, \u00e7al\u0131\u015fman\u0131n hukuki zeminini olu\u015fturmaktad\u0131r. Din \u00f6zg\u00fcrl\u00fc\u011f\u00fc ba\u011flam\u0131nda m\u00fcft\u00fc se\u00e7imlerine y\u00f6nelik devlet m\u00fcdahalesi ve vak\u0131f idarelerinin \u00f6zerk yap\u0131s\u0131n\u0131n gasp edilmesiyle derinle\u015fen ihlal silsilesi, az\u0131nl\u0131\u011f\u0131n dini ve sosyal otonomisine kar\u015f\u0131 yap\u0131sal bir tehdit olu\u015fturmaktad\u0131r. E\u011fitim alan\u0131nda ise az\u0131nl\u0131k okullar\u0131n\u0131n say\u0131s\u0131ndaki keskin d\u00fc\u015f\u00fc\u015f\u00fcn basit bir idari tasarruf olman\u0131n \u00f6tesinde, az\u0131nl\u0131k kimli\u011finin korunmas\u0131na y\u00f6nelik toplumsal haf\u0131zay\u0131 hedefleyen sistematik bir a\u015f\u0131nd\u0131rma politikas\u0131 oldu\u011fu ger\u00e7e\u011fini uluslararas\u0131 toplumun dikkatine sunuyoruz.<\/p>\n\n\n\n<p>WOLAS olarak bu \u00e7al\u0131\u015fmam\u0131zla, &#8220;T\u00fcrk M\u00fcsl\u00fcman&#8221; kimli\u011finin tan\u0131nmas\u0131na y\u00f6nelik hukuki engellerin kald\u0131r\u0131lmas\u0131 ve az\u0131nl\u0131k haklar\u0131n\u0131n fiilen uygulanmas\u0131 noktas\u0131nda y\u00fcr\u00fct\u00fclecek savunuculuk faaliyetlerinin \u00f6nemine dikkat \u00e7ekiyoruz. Bu vesileyle Yunanistan \u00fczerindeki denetim mekanizmalar\u0131n\u0131 harekete ge\u00e7irmenin yan\u0131nda, T\u00fcrkiye\u2019deki ve d\u00fcnyadaki uluslararas\u0131 hukuk \u00e7evrelerine Bat\u0131 Trakya\u2019daki hukuki darbo\u011faza ve \u00e7\u0131kmaza odaklanman\u0131n \u00f6nemini vurguluyoruz. Yak\u0131n zamanda tam metnini kamuoyu ile payla\u015faca\u011f\u0131m\u0131z rapor, hem ulusal hem de uluslararas\u0131 karar al\u0131c\u0131 makamlara resmi olarak iletilecek olup; Bat\u0131 Trakya T\u00fcrk Az\u0131nl\u0131\u011f\u0131\u2019n\u0131n hak aray\u0131\u015f\u0131na katk\u0131 sunmas\u0131n\u0131 temenni ediyoruz.
