Ayn\u0131 dava kapsam\u0131nda, Andrabi\u2019nin \u00e7al\u0131\u015fma arkada\u015flar\u0131 Nahida Nasreen ve Sofi Fehmeeda&#8217;n\u0131n da bug\u00fcn Hindistan mahkemelerince ayr\u0131 ayr\u0131 30 y\u0131l hapis cezas\u0131na \u00e7arpt\u0131r\u0131lmas\u0131, b\u00f6lgedeki hukuki garabetin ula\u015ft\u0131\u011f\u0131 boyutu g\u00f6zler \u00f6n\u00fcne sermektedir. Cammu ve Ke\u015fmir halk\u0131n\u0131n, Birle\u015fmi\u015f Milletler (BM) g\u00fcvencesi alt\u0131ndaki kendi kaderini tayin hakk\u0131 (self-determinasyon) \u00e7er\u00e7evesinde y\u00fcr\u00fctt\u00fc\u011f\u00fc me\u015fru siyasi direni\u015fin, Yasad\u0131\u015f\u0131 Faaliyetleri \u00d6nleme Yasas\u0131 (UAPA) gibi mu\u011flak metinler \u00fczerinden s\u00f6zde &#8220;ter\u00f6r&#8221; su\u00e7lamalar\u0131na konu edilmesi; Hindistan&#8217;\u0131n BM G\u00fcvenlik Konseyi nezdinde bizzat \u00fcstlendi\u011fi uluslararas\u0131 taahh\u00fctleri hukuken h\u00fck\u00fcms\u00fcz k\u0131lma gayretinin a\u00e7\u0131k bir tezah\u00fcr\u00fcd\u00fcr.<\/p>\n\n\n\n<p>On y\u0131llard\u0131r s\u00fcregelen i\u015fgal mekanizmas\u0131, a\u011f\u0131r sava\u015f su\u00e7lar\u0131 te\u015fkil eden eylemlerini geni\u015f bir cezas\u0131zl\u0131k z\u0131rh\u0131 ard\u0131nda f\u00fctursuzca s\u00fcrd\u00fcrmektedir. Bu ba\u011flamda yasal \u00e7er\u00e7eveler; siyasi aktivistleri, \u00f6d\u00fcll\u00fc insan haklar\u0131 savunucular\u0131n\u0131, avukatlar\u0131 ve di\u011fer meslek profesyonellerini susturman\u0131n yan\u0131 s\u0131ra, Hindistan y\u00f6netimindeki Cammu ve Ke\u015fmir\u2019de uygulanan demografik m\u00fchendisli\u011fi ve yerle\u015fimci \u015fiddetini normalle\u015ftirmek amac\u0131yla sistematik birer bask\u0131 ayg\u0131t\u0131 olarak ara\u00e7salla\u015ft\u0131r\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p>Son y\u0131llarda hayata ge\u00e7irilen yasal ve idari d\u00fczenlemeler, yerinden etme ve cebri bask\u0131 politikalar\u0131yla birle\u015fti\u011finde, b\u00f6lgenin demografik ve siyasi karakterinin sistematik bir d\u00f6n\u00fc\u015f\u00fcme u\u011frat\u0131ld\u0131\u011f\u0131n\u0131 \u015f\u00fcpheye mahal b\u0131rakmayacak \u015fekilde kan\u0131tlamaktad\u0131r. S\u00f6z konusu fiili durum yaln\u0131zca hukuk d\u0131\u015f\u0131 bir alanda cereyan etmemekte; aksine, bizzat &#8220;hukuk&#8221; formunun, m\u00fclks\u00fczle\u015ftirmeyi kurumsalla\u015ft\u0131rmak ve Ke\u015fmir\u2019in varl\u0131\u011f\u0131n\u0131 yasal k\u0131l\u0131flarla ortadan kald\u0131rmak \u00fczere yeniden kurguland\u0131\u011f\u0131n\u0131 g\u00f6stermektedir.<\/p>\n\n\n\n<p>Kapsaml\u0131 yasal \u00e7er\u00e7eveler kisvesi alt\u0131nda dayat\u0131lan hukuki dayanaktan yoksun kararlar ve siyasi saiklerle kurulan h\u00fck\u00fcmler, uluslararas\u0131 insanc\u0131l hukuk ve uluslararas\u0131 insan haklar\u0131 hukuku normlar\u0131n\u0131 a\u011f\u0131r bi\u00e7imde ihlal etmektedir. Uzun s\u00fcreli keyfi tutukluluk halleri, adil yarg\u0131lanma hakk\u0131n\u0131n rafa kald\u0131r\u0131lmas\u0131 ve fiilen &#8220;do\u011fal \u00f6l\u00fcme kadar hapis&#8221; anlam\u0131na gelen cezalar\u0131n dayat\u0131lmas\u0131; ba\u015fta Medeni ve Siyasi Haklara \u0130li\u015fkin Uluslararas\u0131 S\u00f6zle\u015fme (ICCPR) olmak \u00fczere, Hindistan&#8217;\u0131n taraf oldu\u011fu uluslararas\u0131 y\u00fck\u00fcml\u00fcl\u00fckler \u0131\u015f\u0131\u011f\u0131nda acil bir uluslararas\u0131 hukuki denetimi zaruri k\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p>Hindistan&#8217;\u0131n, \u0130srail\u2019in Filistin&#8217;deki i\u015fgal pratiklerini kopyalayarak Ke\u015fmir&#8217;de benzer bir &#8220;ana vatan&#8221; ill\u00fczyonu yaratma arzusu, uluslararas\u0131 hukukun emredici kurallar\u0131 kar\u015f\u0131s\u0131nda asla me\u015fruiyet kazanamaz.
