S\u00f6zkonusu ki\u015filer, Moldova-\u0130srailuyruklu ZviKogan\u2019\u0131n ka\u00e7\u0131r\u0131lmas\u0131 ve planl\u0131 \u015fekilde \u00f6ld\u00fcr\u00fclmesiyle su\u00e7lanm\u0131\u015ft\u0131r. D\u00f6rd\u00fcnc\u00fc bir ki\u015fi ise m\u00fcebbet hapis ve cezas\u0131n\u0131n infaz\u0131n\u0131n ard\u0131ndan s\u0131n\u0131r d\u0131\u015f\u0131 edilme cezas\u0131na \u00e7arpt\u0131r\u0131lm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>1992 tarihli ve 35 say\u0131l\u0131 Ceza Muhakemesi Usul\u00fc Hakk\u0131nda Federal Kanun\u2019un 230. maddesine g\u00f6re \u2014ki bu kanun, Birle\u015fik Arap Emirlikleri\u2019nde ceza yarg\u0131lamalar\u0131n\u0131n i\u015fleyi\u015fini d\u00fczenleyen temel mevzuatt\u0131r\u2014 bir temyiz mahkemesi taraf\u0131ndan verilen idam karar\u0131, herhangi bir itiraz olmasa dahi, zorunlu olarak Federal Y\u00fcksek Mahkeme\u2019nin incelemesine sunulmal\u0131d\u0131r. Bu \u00e7er\u00e7evede, Abu Dabi Federal Temyiz Mahkemesi\u2019nin verdi\u011fi karar Federal Y\u00fcksek Mahkeme taraf\u0131ndan temyiz denetimine tabi tutulacakt\u0131r. Ayr\u0131ca, 2021 tarihli ve 31 say\u0131l\u0131 Federal Kararname Kanunu\u2019nun 384. maddesi uyar\u0131nca, yarg\u0131 s\u00fcreci tamamland\u0131ktan sonra, herhangi bir idam cezas\u0131n\u0131n infaz\u0131, Birle\u015fik Arap Emirlikleri Cumhurba\u015fkan\u0131\u2019n\u0131n onay\u0131na ba\u011fl\u0131d\u0131r.<\/p>\n\n\n\n<p>WOLAS olarak, a\u011f\u0131r su\u00e7lar\u0131n adil, \u015feffaf ve hukuka uygun yarg\u0131 s\u00fcre\u00e7leriyle soru\u015fturulmas\u0131 gerekti\u011fini kabul etmekle birlikte, idam cezas\u0131n\u0131n do\u011fas\u0131 gere\u011fi ya\u015fam hakk\u0131yla ve insan haklar\u0131 hukukunda a\u00e7\u0131k\u00e7a yasaklanan i\u015fkence, insanl\u0131k d\u0131\u015f\u0131 ya da onur k\u0131r\u0131c\u0131 ceza ve muamelelerle ba\u011fda\u015fmad\u0131\u011f\u0131n\u0131 belirtmekteyiz.<\/p>\n\n\n\n<p>Mevcut davada:<\/p>\n\n\n\n<p>(i) Karar, Devlet G\u00fcvenli\u011fi mahkemesinde, <em>\u00f6zel bir mahkemede <\/em>al\u0131nm\u0131\u015ft\u0131r;<\/p>\n\n\n\n<p>(ii) Su\u00e7lamalar, adil yarg\u0131lanma g\u00fcvencelerinin s\u0131kl\u0131kla k\u0131s\u0131tland\u0131\u011f\u0131 ter\u00f6rizm kapsam\u0131nda de\u011ferlendirilmi\u015ftir;<\/p>\n\n\n\n<p>(iii) Deliller aras\u0131nda yer alan <em>itiraflar\u0131n<\/em><em>1<\/em><em>&nbsp;<\/em>\u2014ki bu t\u00fcr davalarda \u00e7o\u011funlukla i\u015fkence ya da k\u00f6t\u00fc muamele yoluyla elde edildi\u011fine dair endi\u015feler mevcuttur2\u2014 i\u00e7eri\u011fi net de\u011fildir;<\/p>\n\n\n\n<p>(iv) Dava, \u0130brahimAnla\u015fmalar\u0131 \u00e7er\u00e7evesinde BAE ile \u0130srail aras\u0131ndaki siyasal ili\u015fkiler ba\u011flam\u0131nda yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131n etkilendi\u011fi bir atmosferde y\u00fcr\u00fct\u00fclmektedir;<\/p>\n\n\n\n<p>(v) San\u0131klar\u0131n tam ve etkili bir hukuki temsilden, konsolosluk yard\u0131m\u0131ndan ve kamuya a\u00e7\u0131k yarg\u0131lamadan yoksun b\u0131rak\u0131ld\u0131\u011f\u0131na dair g\u00fcvenilir iddialar g\u00fcndeme gelmi\u015ftir.<\/p>\n\n\n\n<p>Bu nedenlerle, adil yarg\u0131lanma hakk\u0131, yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 ve zorla itiraf al\u0131nmas\u0131 riskleri konusunda ciddi endi\u015felerimizi bu metinde yetkililerle ve kamuoyuyla payla\u015fmaktay\u0131z.<\/p>\n\n\n\n<p>1&nbsp;https:\/\/www.wam.ae\/a\/bixy8nr<\/p>\n\n\n\n<p>2&nbsp;The report of the Special Rapporteur on extrajudicial, summary or arbitrary executions, Morris Tidball-Binz, transmitted to&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; the&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; UN&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; General&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Assembly&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; on&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 5&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; August&nbsp;&nbsp;&nbsp; 2022, <a href=\"https:\/\/digitallibrary.un.org\/record\/3987211\/files\/A_77_270-EN.pdf\">https:\/\/digitallibrary.un.org\/record\/3987211\/files\/A_77_270-EN.pdf, <\/a>p15.<\/p>\n\n\n\n<p><strong>Dokunulmaz Bir Hak Olarak Ya\u015fam Hakk\u0131<\/strong><\/p>\n\n\n\n<p>Su\u00e7un a\u011f\u0131rl\u0131\u011f\u0131 ne olursa olsun, idam cezas\u0131 temel insan haklar\u0131n\u0131n a\u00e7\u0131k bir ihlalini te\u015fkil eder.<\/p>\n\n\n\n<p>Bu ba\u011flamda \u00f6zellikle \u015fu d\u00fczenlemelere ayk\u0131r\u0131l\u0131k s\u00f6z konusudur:<\/p>\n\n\n\n<p>\u00b7&nbsp;&nbsp;&nbsp; Medeni ve Siyasi Haklara \u0130li\u015fkin Uluslararas\u0131 S\u00f6zle\u015fme\u2019nin (ICCPR) 6. Maddesi, Devletlere idam cezas\u0131n\u0131 k\u0131s\u0131tlamalar\u0131 ve nihayetinde tamamen kald\u0131rmalar\u0131 y\u00f6n\u00fcnde a\u00e7\u0131k bir y\u00fck\u00fcml\u00fcl\u00fck getirmektedir. Birle\u015fik Arap Emirlikleri, bu alandaki taahh\u00fctlerine ayk\u0131r\u0131 bi\u00e7imde \u00f6l\u00fcm cezas\u0131n\u0131n t\u00fcm\u00fcyle kald\u0131r\u0131lmas\u0131 y\u00f6n\u00fcnde herhangi bir ad\u0131m atmamaktad\u0131r. Bu y\u00fck\u00fcml\u00fcl\u00fck, s\u00f6z konusu S\u00f6zle\u015fme\u2019ye Ek \u0130kinci Se\u00e7meli Protokol ile de teyit edilmi\u015ftir. Ayr\u0131ca BAE, Birle\u015fmi\u015f Milletler Genel Kurulu\u2019nda idam cezas\u0131na ili\u015fkin moratoryum \u00e7a\u011fr\u0131s\u0131 i\u00e7eren kararlara sistematik olarak olumsuz oy kullanmakta ve bu tutumuyla uluslararas\u0131 insan haklar\u0131 hukukunda olu\u015fan yerle\u015fik e\u011filime muhalif bir pozisyonda durmaktad\u0131r.<\/p>\n\n\n\n<p>\u00b7&nbsp;&nbsp;&nbsp; Ayn\u0131 maddenin bir di\u011fer h\u00fckm\u00fc, &#8220;\u00f6l\u00fcm cezas\u0131na \u00e7arpt\u0131r\u0131lan herkesin af veya cezan\u0131n hafifletilmesini talep etme hakk\u0131na sahip oldu\u011funu&#8221; a\u00e7\u0131k\u00e7a belirtmekte; bu t\u00fcrden bir hafifletme ya da af karar\u0131n\u0131n &#8220;t\u00fcm h\u00e2llerde verilebilece\u011fini&#8221; vurgulamaktad\u0131r.<\/p>\n\n\n\n<p>\u00b7&nbsp;&nbsp;&nbsp; Uluslararas\u0131 team\u00fcl hukukuna g\u00f6re, idam cezalar\u0131n\u0131n geri d\u00f6nd\u00fcr\u00fclemez niteli\u011fi \u00f6zellikle vurgulanmakta; bu cezan\u0131n usule ayk\u0131r\u0131l\u0131klar, avukata eri\u015fim hakk\u0131n\u0131n engellenmesi ya da yarg\u0131n\u0131n ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 ve tarafs\u0131zl\u0131\u011f\u0131na y\u00f6nelik \u015f\u00fcphelerin bulundu\u011fu&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; durumlarda&nbsp;&nbsp;&nbsp;&nbsp; uygulanmas\u0131,&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; ciddi&nbsp;&nbsp;&nbsp;&nbsp; bir&nbsp;&nbsp;&nbsp;&nbsp; hukuki&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; sorun&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; olarak de\u011ferlendirilmektedir. Bu t\u00fcr ko\u015fullarda, mahkeme karar\u0131yla verilmi\u015f dahi olsa, idam cezas\u0131 keyf\u00ee ya\u015famdan yoksun b\u0131rakma olarak nitelendirilmekte ve bu durum uluslararas\u0131 hukuka a\u00e7\u0131k\u00e7a ayk\u0131r\u0131l\u0131k te\u015fkil etmektedir.<\/p>\n\n\n\n<p><strong>\u0130d<\/strong><strong>am Cezas\u0131n\u0131n \u0130\u015fkencenin Mutlak Yasa\u011f\u0131yla \u0130li\u015fkisi<\/strong><\/p>\n\n\n\n<p>Birle\u015fik Arap Emirlikleri (BAE), idam cezas\u0131n\u0131n kald\u0131r\u0131lmas\u0131na y\u00f6nelik uluslararas\u0131 s\u00f6zle\u015fmelere taraf olmamakta ve bu alandaki y\u00fck\u00fcml\u00fcl\u00fcklerden bilin\u00e7li olarak uzak durmay\u0131 tercih etmektedir. Ancak buna ra\u011fmen, BAE \u0130\u015fkence ve Di\u011fer Zalimane, Gayriinsan\u00ee veya K\u00fc\u00e7\u00fclt\u00fcc\u00fc Muamele ya da Cezaya Kar\u015f\u0131 Birle\u015fmi\u015f Milletler S\u00f6zle\u015fmesi\u2019ne (CAT) 19 Temmuz 2012 tarihinde taraf olmu\u015f olup, bu itibarla S\u00f6zle\u015fme kapsam\u0131ndaki y\u00fck\u00fcml\u00fcl\u00fckler kendisi a\u00e7\u0131s\u0131ndan ba\u011flay\u0131c\u0131d\u0131r. Taraf Devlet s\u0131fat\u0131yla BAE, S\u00f6zle\u015fme\u2019nin 2. maddesinde yer alan i\u015fkencenin mutlak yasa\u011f\u0131na uymakla ve her t\u00fcrl\u00fc i\u015fkence eylemini soru\u015fturmak, failleri kovu\u015fturmak ve cezaland\u0131rmakla y\u00fck\u00fcml\u00fcd\u00fcr. Bu y\u00fck\u00fcml\u00fcl\u00fckler, hi\u00e7bir istisnaya t\u00e2bi tutulamaz ve ceza soru\u015fturmas\u0131 ile yarg\u0131laman\u0131n t\u00fcm a\u015famalar\u0131nda ge\u00e7erlili\u011fini korur.<\/p>\n\n\n\n<p>BAE Devlet G\u00fcvenlik Savc\u0131l\u0131\u011f\u0131 taraf\u0131ndan \u00fc\u00e7 \u00d6zbek vatanda\u015fa ili\u015fkin davada sunulan delillerin, <em>ayr\u0131nt\u0131l\u0131 itiraflar\u0131<\/em>, adli t\u0131p ve otopsi raporlar\u0131n\u0131, tan\u0131k beyanlar\u0131n\u0131 ve iddia edilen su\u00e7larda kullan\u0131ld\u0131\u011f\u0131 belirtilen ara\u00e7lar\u0131n tasvirlerini i\u00e7erdi\u011fi bildirilmi\u015ftir. Bu ba\u011flamda BM Keyf\u00ee, Yarg\u0131s\u0131z veya Usuls\u00fcz \u0130nfazlar \u00d6zel Raport\u00f6r\u00fc Morris Tidball-Binz taraf\u0131ndan 2022<\/p>\n\n\n\n\n\n<p>y\u0131l\u0131nda Genel Kurul\u2019a sunulan raporda (A\/77\/270), \u00f6l\u00fcm cezas\u0131 verilmeden \u00f6nce i\u015fkencenin ger\u00e7ekle\u015febilece\u011fi uyar\u0131s\u0131 dikkate al\u0131nmal\u0131d\u0131r: \u201c<em>\u0130\u015fkence, birey hen\u00fcz idam cezas\u0131na \u00e7arpt\u0131r\u0131lmadan \u00f6nce uygulanabilmektedir; \u00f6l\u00fcmle cezaland\u0131r\u0131labilecek bir su\u00e7la itham edilen ki\u015filerin maruz kald\u0131\u011f\u0131 muameleye dair \u00e7ok say\u0131da bildirim al\u0131nm\u0131\u015ft\u0131r. Bu vakalarda hukuk\u00ee temsile eri\u015fimin engellenmesi ve zorla itiraf almak amac\u0131yla i\u015fkence ya da k\u00f6t\u00fc muameleye ba\u015fvurulmas\u0131 \u00f6ne \u00e7\u0131kmaktad\u0131r.<\/em>\u201d3<\/p>\n\n\n\n<p>Bu gibi ko\u015fullar, verilen idam kararlar\u0131n\u0131n bask\u0131 alt\u0131nda al\u0131nan ya da g\u00fcvenilirli\u011fi \u015f\u00fcpheli delillere dayand\u0131r\u0131lmas\u0131 riskini ciddi bi\u00e7imde art\u0131rmaktad\u0131r.<\/p>\n\n\n\n<p>Bu hukuk\u00ee \u00e7eli\u015fki, uzun zamand\u0131r \u00e7e\u015fitli insan haklar\u0131 mekanizmalar\u0131 taraf\u0131ndan da vurgulanmaktad\u0131r. 2012 y\u0131l\u0131nda \u0130\u015fkence \u00d6zel Raport\u00f6r\u00fc Juan E. M\u00e9ndez, idam cezas\u0131n\u0131n mutlak i\u015fkence yasa\u011f\u0131 perspektifinden de\u011ferlendirilmesi gerekti\u011fini ve bu yakla\u015f\u0131m\u0131n olu\u015fmakta olan bir team\u00fcl kural\u0131 niteli\u011fi kazand\u0131\u011f\u0131n\u0131 belirtmi\u015ftir.4&nbsp;\u00d6nceki raport\u00f6rlerden Say\u0131n Wako da, i\u015fkencenin yasaklanmas\u0131n\u0131n \u201cidam cezas\u0131na giden t\u00fcm s\u00fcre\u00e7 boyunca ve s\u00fcrecin her a\u015famas\u0131nda\u201d ge\u00e7erli oldu\u011funun alt\u0131n\u0131 \u00e7izmi\u015ftir.5<\/p>\n\n\n\n<p>\u0130dam cezas\u0131n\u0131n do\u011fas\u0131nda bulunan sertlik ve ac\u0131mas\u0131zl\u0131k, uluslararas\u0131 hukukta gitgide daha fazla i\u015fkence, insanl\u0131k d\u0131\u015f\u0131 veya a\u015fa\u011f\u0131lay\u0131c\u0131 muamele ya da ceza (CIDTP) kapsam\u0131nda ele al\u0131nmaktad\u0131r. Bu denetim yaln\u0131zca infaz an\u0131na de\u011fil, infaza giden t\u00fcm s\u00fcreci kapsamaktad\u0131r: \u00f6l\u00fcm h\u00fccresinde ge\u00e7irilen uzun y\u0131llar, tecrit ko\u015fullar\u0131, yetersiz t\u0131bbi bak\u0131m, ve \u201c<em>\u00f6l\u00fcm h\u00fccresi sendromu<\/em>\u201d olarak bilinen psikolojik tahribat. BM \u0130nsan Haklar\u0131 Komitesi (Genel Yorum No. 20) veAvrupa \u0130nsan Haklar\u0131 Mahkemesi\u2019nin <em>Soering v. Birle\u015fik Krall\u0131k <\/em>karar\u0131 gibi i\u00e7tihatlarda, bu ko\u015fullar\u0131n CIDTP te\u015fkil edebilece\u011fi a\u00e7\u0131k\u00e7a kabul edilmi\u015ftir.<\/p>\n\n\n\n<p>\u0130nfaz y\u00f6ntemleri \u2014\u00f6rne\u011fin asma, elektrikle idam, ya da zehirli i\u011fne\u2014 prosed\u00fcrel hatalar ve fizyolojik belirsizlikler nedeniyle s\u0131kl\u0131kla uzun s\u00fcren ve ac\u0131 dolu \u00f6l\u00fcmlerle sonu\u00e7lanmaktad\u0131r. Ayr\u0131ca, adaletsiz yarg\u0131lamalarda ya da ak\u0131l hastal\u0131\u011f\u0131 ve zihinsel engelli bireylerin yarg\u0131lanmas\u0131nda keyfilik ve ayr\u0131mc\u0131l\u0131k ihtimali h\u00e2len y\u00fcksek d\u00fczeyde devam etmektedir.6<\/p>\n\n\n\n<p>Uluslararas\u0131 insan haklar\u0131 hukuk\u00e7usu William Schabas\u2019\u0131n \u00e7arp\u0131c\u0131 ifadesiyle:\u201c<em>Bir ki\u015fiden zorla itirafalmaki\u00e7in v\u00fccuduna elektrikak\u0131m\u0131verirseniz, bu i\u015fkenceolurveMedeniveSiyasiHaklar S\u00f6zle\u015fmesi\u2019nin 7. maddesini ihlal edersiniz.
